1. Agreement

These Terms of Service ("Terms") govern your access to and use of fuelant websites, mobile applications, and related services (collectively, the "Services") operated by fuelant ("we," "us," or "our"). By creating an account, purchasing a subscription, or using the Services, you agree to these Terms and our Privacy Policy.

2. Who we are

fuelant provides personalized endurance fueling guidance for athletes. Contact: contact@getfuelant.com. Privacy requests: privacy@getfuelant.com.

3. Eligibility & accounts

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Services. You are responsible for keeping your login credentials confidential and for activity under your account. You may delete your account in-app (Settings) or by contacting us; deletion is irreversible once completed.

4. Not medical advice

fuelant provides educational and training-support tools related to hydration, carbohydrate, and sodium planning. The Services are not medical advice, diagnosis, or treatment. Always consult a qualified healthcare professional before changing nutrition, hydration, or training practices, especially if you have a medical condition. You use the Services at your own risk.

5. Health & wearable data

With your permission, the mobile app may read health and fitness data (for example via Apple HealthKit, Google Health Connect, Terra, Strava, or similar integrations) to personalize fueling targets. You control permissions on your device. How we handle that data is described in our Privacy Policy, including that HealthKit data is not used for advertising and is not sold.

6. Subscriptions & billing

• Web: Paid plans on getfuelant.com are billed through Stripe. Prices, trial length, and renewal terms are shown at checkout.
• iOS / Android apps: In-app subscriptions are purchased through Apple App Store or Google Play and managed by those platforms (including free trials where offered). Payment is charged to your store account. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period in your device subscription settings.
• Refunds for store purchases are handled under Apple or Google policies. Web refunds follow our Stripe / support process where applicable.
• You can restore eligible mobile purchases using the "Restore Purchases" control in the app paywall.

7. Acceptable use

You agree not to misuse the Services, including attempting to access other users' data, reverse engineer the Services except where permitted by law, abuse APIs, scrape content at scale, or use the Services for unlawful purposes. We may suspend or terminate accounts that violate these Terms.

8. Intellectual property

The Services, branding, and software are owned by fuelant or our licensors. You retain ownership of content you submit; you grant us a limited license to host and process that content solely to operate the Services.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that fueling recommendations will prevent injury, illness, or underperformance.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FUELANT AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM.

11. Indemnity

You agree to indemnify and hold harmless fuelant from claims arising out of your misuse of the Services or violation of these Terms, except to the extent caused by our willful misconduct.

12. Changes

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes become effective constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the United States and the State of Colorado, without regard to conflict-of-law rules, except where mandatory consumer protections in your country apply.
